DMCA Policy

Digital Millennium Copyright Act (DMCA) Policy

3. Filing a DMCA Takedown Notice

If you are a copyright owner (or an authorized representative) and believe that content hosted on our servers infringes your copyright, you may submit a DMCA takedown notice with the following information:

3.1 Required Information in a DMCA Notice

Your DMCA notice must include:

  1. Your Contact Information

    • Full legal name
    • Company name (if applicable)
    • Mailing address
    • Phone number
    • Email address

  2. Identification of the Copyrighted Work

    • A description of the copyrighted content that has been infringed (e.g., a book, image, video, article, etc.).
    • A link to the original copyrighted work (if available).

  3. Identification of the Infringing Content

    • A direct URL(s) to the infringing content hosted on our platform.

  4. A Statement of Good Faith

    • Example: “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”

  5. A Statement of Accuracy and Authority

    • Example: “I swear, under penalty of perjury, that the information provided in this notice is accurate and that I am the copyright owner or authorized to act on behalf of the copyright owner.”

  6. Your Physical or Electronic Signature

3.2 How to Submit a DMCA Notice

  • Email: Send the notice to dmca@quantumhostsolutions.com with the subject line “DMCA Takedown Notice”.
  • Mail: Send a hard copy to our DMCA Agent at the address listed above.

Once we receive a complete and valid DMCA notice, we will review the claim and may remove or disable access to the allegedly infringing content.

4. Counter-Notification Process

If you believe that the content you uploaded was removed in error, you may submit a counter-notification requesting reinstatement of the content.

4.1 Required Information in a Counter-Notice

Your counter-notification must include:

  1. Your Contact Information

    • Full legal name
    • Mailing address
    • Phone number
    • Email address

  2. Identification of the Removed Content

    • The specific URLs of the content that was removed.

  3. A Statement of Good Faith

    • Example: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed as a result of a mistake or misidentification.”

  4. A Statement of Consent to Legal Jurisdiction

    • If you reside in the United States: “I consent to the jurisdiction of the federal courts located in Michigan and will accept service of process from the person who provided the DMCA notification or their agent.”
    • If you reside outside the United States: “I consent to the jurisdiction of any United States federal court where QuantumHost Solutions LLC operates.”

  5. Your Physical or Electronic Signature

4.2 How to Submit a Counter-Notice

  • Email: Send to dmca@quantumhostsolutions.com with the subject line “DMCA Counter-Notification”.
  • Mail: Send to our DMCA Agent at the address listed above.

Once we receive a valid counter-notice, we may restore the content within 10-14 business days, unless the original complainant initiates a court action against you.

5. Repeat Infringers

QuantumHost Solutions LLC has a zero-tolerance policy for repeat infringers. Accounts with multiple valid DMCA violations may face:

  • Content suspension or removal
  • Temporary or permanent account termination

6. Misuse of the DMCA Policy

Filing a fraudulent or misleading DMCA notice or counter-notice is illegal and may result in legal consequences, including damages, attorneys’ fees, and penalties under 17 U.S.C. § 512(f).

7. Third-Party Content & Liability

  • QuantumHost Solutions LLC does not review or monitor user-uploaded content before it is posted.
  • We act as a service provider and comply with the DMCA Safe Harbor provisions (17 U.S.C. § 512).
  • We are not liable for infringing content uploaded by users.

8. Modifications to This DMCA Policy
